Types of Assault Charges 

Oregon Revised Statute § 163.160, § 163.165, § 163.175, and § 163.185 includes: 

Assault in the First Degree

The most serious assault charges are first degree assault. First degree assault is a Class A felony. 

Maximum Penalties Associated with Assault in the First Degree: 

  • Up to 20 years in prison 
  • Up to $375,000 fines and fees 

Mandatory Minimum Penalties Associated with Assault in the First Degree:

  • If convicted of Assault in the Second Degree in Oregon, Measure 11 requires a mandatory minimum sentence of 7 years and 6 months in prison, regardless of other circumstances. 

Assault in the Second Degree

Third degree assault is a Class B felony.

Maximum Penalties Associated with Assault in the Second Degree: 

  • Up to 10 years in prison
  • Up to $250,000 fines and fees 

Mandatory Minimum Penalties Associated with Assault in the Second Degree: 

  • If convicted of Assault in the Second Degree in Oregon, Measure 11 requires a mandatory minimum sentence of 7 years and 6 months in prison, regardless of other circumstances. 

Assault in the Third Degree

Third degree assault is a Class C felony. Maximum Penalties Associated with Assault in the Third Degree: 

  • Up to 5 years in prison 
  • Up to $125,000 fines and fees 

Assault in the Fourth Degree

Fourth degree assault is the lowest level assault charge you can be charged with under Oregon law. Assault in the Fourth Degree is a Class A misdemeanor. 

Maximum Penalties Associated with Assault in the Fourth Degree: 

  • Up to 1 year in jail 
  • Up to $6,250 fines and fees
